1. Acceptance of Terms

By accessing or using Court Access ("Service"), provided by Sailor's Bail Bonds ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Court Access is a bail bond management platform that provides:

  • Client management and tracking
  • Court date scheduling and reminders
  • Document management and storage
  • SMS and email notification services
  • Court Investigator premium services (optional add-on)
  • Analytics and reporting

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. Subscription and Payment

4.1 Subscription Plans

We offer the following subscription plans:

  • Setup Fee: $2,000.00 one-time - Account configuration, training, and onboarding
  • Monthly Subscription: $280.17/month - Full platform access with all features
  • Court Investigator Add-On: $859 setup fee + $159/month

4.2 Billing

Subscriptions are billed monthly in advance. All fees are non-refundable except as required by law. We may change pricing with 30 days' notice.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or interfere with the Service
  • Attempt to gain unauthorized access to systems
  • Use the Service to harass or harm others
  • Send unsolicited communications (spam)

6. SMS and Communication Services

6.1 Consent

By using our SMS reminder services, you confirm that you have obtained proper consent from recipients as required by the Telephone Consumer Protection Act (TCPA) and other applicable laws.

6.2 Message Rates

Standard message and data rates may apply to recipients. Message frequency varies based on court date schedules.

6.3 Opt-Out

Recipients may opt out of SMS messages by replying STOP at any time. You agree to honor all opt-out requests immediately.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You agree that:

  • You have the right to input and process the data you provide
  • You will comply with all applicable data protection laws
  • You will obtain necessary consents from data subjects

8. Intellectual Property

The Service and its original content, features, and functionality are owned by the Company and are protected by copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

11. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

13. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our sole discretion.

14. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in Sacramento County, California, in accordance with the rules of the American Arbitration Association.
